Long Creek November Update

If you are required to obtain a Long Creek Permit you may have recently received a letter from the Maine DEP regarding the renewal of the Post-Construction Discharge of Stormwater in the Long Creek Watershed General Permit. The following are the main points you need to understand:

  • The Long Creek General Permit is the cooperative implementation of the Long Creek Management Plan.
  • If you entered into a Participating Landowner Agreement, you are meeting your permit requirements through paying your biannual assessments and providing easements as outlined in the Long Creek Watershed Management Plan.
  • The Long Creek General Permit is a five year permit, which was issued on November 6, 2009.
  • The existing permit has been administratively extended until June 30, 2015 in order to align the permit with the Long Creek Watershed Management District's fiscal year (July 1 - June 30).
  • This will not change your annual assessment, or your relationship with the District.
  • The Long Creek Watershed Management Plan has always had a ten year timeframe. This has not changed.

The timeline for the renewal of the permit is as follows:

  • November 6, 2014 - Designated landowners sent notification regarding permit renewal
  • February 1, 2015 - Formal 30-day public comment period
  • April 15, 2015 - Response to public comments and forward the permit to the DEP Commissioner for signature, but the permit will not be effective until July 1, 2015
  • April 15, 2015 - designated landowners will have 60 days (until June 15, 2015) in which to either:
    • File a Notice of Intent with the Maine DEP in order to comply with the General Permit. This is the option that you choose if you wish to continue as a Participating Landowner.

    • Submit an application for an individual permit. This option was chosen by only three landowners during the last permit cycle. If you opt to change from General Permit to Individual Permit, your compliance will be prorated based on the value of your contributions to the implementation of the Management Plan over the last five years. Feel free to call us if you think you are going to undertake a substantial redevelopment project in the near future.

As we move forward with the process we will to continue to update you. Staff will be reviewing the draft permit and providing comments on behalf of Participating Landowners. If you would like to comment you can contact us or Maine DEP.
